By accessing our website, making a reservation, or using any services provided by Maya Stoga, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

We reserve the right to modify these terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after any changes constitutes acceptance of the modified terms.

Reservation Process

All reservations are subject to availability and confirmation. A reservation is not confirmed until you receive a written confirmation from Maya Stoga and the required deposit or payment has been processed.

Pricing and Payments

All prices are quoted in US Dollars and are subject to applicable taxes and fees. We accept major credit cards and other payment methods as indicated during the booking process. A deposit is typically required at the time of booking, with the balance due prior to check-in.

Minimum Stay Requirements

Minimum stay requirements vary by property and season. Short-term rentals typically require a minimum of 2-3 nights. Extended stay rentals require a minimum of 30 nights. Special events and holidays may have different minimum stay requirements.

Age Requirement

The primary guest making the reservation must be at least 25 years of age. Valid government-issued identification may be required at check-in.

Property Care

Guests are expected to treat the property with care and respect. You are responsible for any damage to the property, furnishings, or amenities caused by you or members of your party during your stay, beyond normal wear and tear.

Occupancy Limits

The maximum number of guests permitted is specified in your reservation confirmation. Exceeding the stated occupancy limit is a violation of these terms and may result in immediate termination of your stay without refund.

House Rules

Each property has specific house rules that will be provided before or upon check-in. Guests must comply with all house rules, including quiet hours, parking restrictions, pool/hot tub usage, and any other property-specific guidelines.

Prohibited Activities

The following activities are strictly prohibited at all Maya Stoga properties: smoking (including e-cigarettes) inside properties, unauthorized parties or events, illegal activities, excessive noise, and subletting or transferring reservations without prior written consent.

Pet Policy

Pet policies vary by property. If pets are allowed, guests must disclose all pets at the time of booking and adhere to pet-specific rules. Additional pet fees and deposits may apply. Guests are responsible for any damage caused by their pets.

Check-In and Check-Out

Standard check-in time is 4:00 PM and check-out time is 11:00 AM, unless otherwise specified. Early check-in or late check-out may be available upon request and may incur additional fees. Please contact us in advance to inquire about availability.

Keys and Access

Access instructions will be provided prior to your arrival. Guests are responsible for securing the property during their stay. Lost keys or access devices may result in additional charges for replacement and/or lock changes.

Property Amenities

Amenities vary by property and are listed in the property description. While we strive to ensure all amenities are functional, occasional equipment malfunctions may occur. We will make reasonable efforts to address any issues promptly.

Property Access by Owner/Manager

Maya Stoga reserves the right to enter the property for maintenance, inspection, or emergencies. Except in emergencies, we will provide reasonable notice before entering the property during your stay.

Limitation of Liability

Maya Stoga shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or properties. Our total liability shall not exceed the amount paid for your reservation.

Personal Property

Maya Stoga is not responsible for loss, theft, or damage to guests' personal property during their stay. Guests are encouraged to secure valuables and consider travel insurance for valuable items.

Assumption of Risk

Guests acknowledge that vacation rentals may include amenities such as pools, hot tubs, stairs, and outdoor areas that carry inherent risks. Guests assume all risks associated with the use of these amenities and agree to supervise children at all times.

Force Majeure

Maya Stoga shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, wildfires, power outages, government actions, pandemics, or other acts of force majeure.

Indemnification

Guests agree to indemnify and hold harmless Maya Stoga, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the property or violation of these terms.

All content on the Maya Stoga website, including text, graphics, logos, images, and software, is the property of Maya Stoga or its content suppliers and is protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written consent.

Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these terms or your use of our services shall first be addressed through good-faith negotiations. If a resolution cannot be reached, disputes shall be resolved through binding arbitration in Napa County, California, in accordance with the rules of the American Arbitration Association.

Venue

For any disputes not subject to arbitration, you agree to submit to the exclusive jurisdiction of the state and federal courts located in Napa County, California.

Waiver of Class Action

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
